Please read this Agreement carefully before using MyHealer.

Please read these Terms of Use ("Agreement", "Terms of Use") carefully before using MyHealer ("the App", "us", "we", or "our"). This Agreement sets forth the legally binding terms and conditions for your use of the App, MyHealer.

By accessing or using the App in any manner, including, but not limited to, visiting or browsing the App or contributing content or other materials to the App, you agree to be bound by these Terms of Use. Capitalized terms are defined in this Agreement.

Please note that diamonds in our system are virtual credits used exclusively and cannot be withdrawn or converted into real-world cash. They are designed to enhance your in-app experience.

The use of the MyHealer application and services is governed by these Terms of Use. By using MyHealer, you acknowledge that you have read the Terms of Use and the disclaimers contained therein and that you accept and agree to be bound by the terms thereof.

Intellectual Property

The App and its original content, features, and functionality are owned by MyHealer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

INFORMATION PROVIDED THROUGH OUR SERVICES AND IN MYHEALER MATERIALS, INCLUDING BUT NOT LIMITED TO THE INFORMATION PROVIDED IN HOROSCOPES, THE TEXT, GRAPHICS, IMAGES, AND TOOLS POSTED ON VARIOUS PAGES, IS FOR INFORMATIONAL PURPOSE ONLY. ANY AND ALL DECISIONS THAT YOU MAKE THAT ARE BASED IN WHOLE OR IN PART UPON INFORMATION PROVIDED BY MYHEALER OR ITS SPONSORS OR OTHERWISE ON THE APP WILL BE YOUR SOLE AND EXCLUSIVE RESPONSIBILITY.

GENERAL DISCLAIMER

The information provided on, from or through MyHealer, its services, and the app is provided "as-is" and "as available," and all warranties, express or implied, are disclaimed (including but not limited to the disclaimer of any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement). The app and related information and services may contain bugs, errors, problems, or other limitations. MyHealer and our affiliated parties have no liability whatsoever for your use of the app and services and any such information or service. In particular, and without limitation, MyHealer and our affiliated parties are not liable for any indirect, special, incidental, or consequential damages (including damages for loss of business, loss of profits, litigation, or the like), whether based on breach of contract, breach of warranty, tort (including negligence), product liability, or otherwise, even if advised of the possibility of such damages. The disclaimer of damages set forth above is a fundamental element of the basis of the bargain between MyHealer and you. The app and the information and services provided therein would not be provided without such limitations. No advice or information, whether oral or written, obtained by you from MyHealer through the app or services shall create any warranty, representation, or guarantee not expressly stated in these terms of use. MyHealer makes no warranty or representation that the use of the app or services will be uninterrupted or error-free. Neither we nor any of our affiliates have any responsibility or obligation to notify you of your accumulated charges or other expenses with us. The amount of time you spend with the readers will be reflected in your charges and is solely at your own election or choice. We do not monitor usage patterns and are under no obligation to any customer to take any action or to refrain from taking any action with respect to usage of the app or services.

AI-ASSISTED TECHNOLOGY

We may use artificial intelligence or automated technologies in the operation of our Services. The scope of such use includes, but is not limited to, service process optimization, preliminary classification of user needs, basic information response, and other auxiliary functions. You acknowledge and agree that all substantive communications, personalized interpretations, advisory recommendations, and in-depth consultation content constituting our core services are provided by human advisors. Automated tools shall not be used to replace the professional services of our human advisors.

THIRD-PARTY INFORMATION

Any articles, press clippings, or other third-party publications (collectively, "Publications") made available through the app are furnished by MyHealer for your convenience and entertainment. MyHealer is a distributor (and not a publisher) of content supplied by third parties (including users). Any opinions, advice, statements, services, offers, or other information made available by third parties, including psychics, information providers, or any user of the app, are those of the respective author(s) or publisher(s) and not of MyHealer or its affiliates. MyHealer DISCLAIMS ANY REPRESENTATION, EITHER EXPRESS OR IMPLIED, THAT THE INFORMATION IN SUCH PUBLICATIONS IS ACCURATE OR COMPLETE.

RESTRICTIONS; COMPLIANCE WITH LAWS

Your rights to use MyHealer and its services are personal to you. You are solely responsible for the content of your transmissions through the app, and the use of the services is subject to all applicable local, state, national, and international laws and regulations. By using MyHealer, you agree to:

MyHealer reserves the right to terminate your access to and use of the app or services without refund for any violations of these Terms of Use.

Important Note: It is a violation of our Terms of Use to contact any of our psychics outside of the online services or to request their direct contact information. If you violate these terms, we bear no liability for any consequences, and your access to our services may be revoked. Any such violations may be reported to us by our psychics, and such reports will not be considered a violation of our Privacy Policy.

CONSENT TO SHARE YOUR INFORMATION WITH APPLE

We may offer various in-app purchases (IAP) within MyHealer. To verify your account and secure your transaction, digital distribution platforms, such as the Apple Store, may require some of your personal data. By purchasing IAP items, you consent to share some personal information with platform providers like Apple to assist in verifying your account and processing refund requests.

EXTERNAL LINKS

Certain links on MyHealer may direct you away from the app. These linked sites, such as those belonging to our sponsors, are not under MyHealer's control, and we are not responsible for their content. These links are provided for your convenience, and the inclusion of any link does not imply our endorsement.

INTELLECTUAL PROPERTY AND USAGE RIGHTS

All content within MyHealer, including designs, text, graphics, and files, is copyrighted and proprietary property. You are authorized to copy materials published on MyHealer for non-commercial personal use only, retaining all copyright and proprietary notices. Except as explicitly permitted, you may not copy, display, download, distribute, modify, or create derivative works based on content from MyHealer without express written consent. No statement in these Terms of Use shall be construed as conferring any license or right under the intellectual property rights of MyHealer or any third party.

We may limit or restrict access for users who infringe upon intellectual property rights.

SUBMISSIONS AND MATERIAL YOU PROVIDE

You acknowledge responsibility for any material you submit ("Submissions"), including legality, originality, and copyright. You may not upload content that is libelous, defamatory, obscene, threatening, violating privacy rights, abusive, illegal, or otherwise objectionable.

All Submissions are considered non-confidential and non-proprietary. MyHealer has no obligation regarding such Submissions and may use, reproduce, modify, display, and distribute them without limitation. By submitting material to MyHealer, you grant us a perpetual, worldwide, royalty-free, irrevocable license to use such Submissions in any form or medium now known or hereafter developed. You also grant others access to view and use your Submissions for personal use.

It is important to note that MyHealer does not wish to receive confidential information, and any Submissions will be regarded as not confidential.

By submitting content to MyHealer, you provide us and our affiliates the right to display or publish such content on the app and its affiliated platforms, including the right to modify the material at our discretion.

You agree not to submit material that infringes upon the rights of others, is false or misleading, is unlawful or otherwise objectionable, or contains advertisements or solicits business.

We reserve the right to edit, remove, or not publish Submissions without notice.

If you believe your copyright has been infringed, please submit a notice in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512(c)) to our Copyright Agent. Include your contact information and a statement affirming your good faith belief that the use is unauthorized.

TERMINATION

We may terminate your access to MyHealer without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall remain in effect, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

LINKS TO OTHER APPS

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party apps or services. We strongly recommend that you read the terms and conditions and the privacy policy of any third-party app that you may visit.

By using MyHealer, you (a) acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions (including our Privacy Policy), (b) agree to comply with these Terms and Conditions and all applicable laws governing our app, (c) represent and warrant that you are at least 18 years old, are a resident of Hong Kong or lawfully consent to Hong Kong jurisdiction, and have the right, authority, and capacity to enter into these Terms and Conditions on your own behalf or on behalf of an entity you represent. If you do not agree with these terms, you are not authorized to use MyHealer.

GOVERNING LAW

For legal and regulatory compliance, MyHealer is operated by HK Harper Limited, a company registered in Hong Kong. This Agreement (and any further rules, policies, or guidelines incorporated by reference) shall be governed by and construed in accordance with the laws of Hong Kong, without regard to any conflict of law principles.

CHANGES TO THIS AGREEMENT

We reserve the right to modify or replace these Terms of Use by posting the updated terms on MyHealer. Your continued use of the app after such changes constitutes your acceptance of the new Terms of Use. Please review this Agreement periodically for any changes. If you do not agree with these changes, you must stop using the app immediately.

VIOLATION OF THE TERMS AND CONDITIONS

By using MyHealer, you understand and agree that we may, at our discretion and without prior notice, suspend or terminate your access to the app, or any offered services, and may modify or remove any User Content if we believe, in our sole discretion, that the User Content violates or is inconsistent with these Terms and Conditions or its intent, that your conduct is disruptive, or you have violated the law or the rights of MyHealer or another user. We will not be liable for any deletion of your User Content.

LICENSE GRANTED BY YOU

By providing, submitting, or uploading any communication, review, comment, feedback, posting, materials, photographs, or other content for use on MyHealer ("User Content"), you (a) represent and warrant that you own all rights to such User Content, and that it does not violate our Acceptable Use Policy, and (b) grant us an irrevocable, perpetual, royalty-free, fully paid-up, worldwide license to use, reproduce, distribute, publicly display, publicly perform, prepare derivative works of, and otherwise exploit all or any part of the User Content in our sole discretion, subject to our Privacy Policy. Any User Content will be treated as non-confidential and may be used by us for various purposes, including product or service development.

LIMITATION OF LIABILITY

NOTWITHSTANDING ANYTHING TO THE CONTRARY, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO OUR RELATIONSHIP WITH YOU WILL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE APPLICABLE TRANSACTION GIVING RISE TO THE LIABILITY, OR FIFTY DOLLARS ($50) IF THERE HAS BEEN NO PAID TRANSACTION.

Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, this limitation may not apply to you. If any part of this section is held to be unenforceable, liability will be limited to the fullest extent of applicable law.

Agreement to Arbitrate Disputes

Arbitration costs will generally be determined by the AAA's fee schedule; however, if you demonstrate that your share of the costs would be prohibitively high compared to litigation costs, we may cover as much of your arbitration costs as the arbitrator finds necessary. Each party will bear its own attorney's fees unless there is a relevant law requiring that attorneys' fees be paid to the prevailing party.

Exceptions for Intellectual Property Disputes

In the case where a dispute relates to a violation of intellectual property rights, both parties agree that the non-infringing party may seek injunctive relief in a court appropriate for such matters in accordance with the "Governing Law" section beneath. Both parties thus consent to the exclusive jurisdiction of those courts.

SEVERABILITY

If any provision of these Terms and Conditions is deemed invalid, void, or unenforceable, the remaining provisions will continue to remain in full force and effect. The invalid, void, or unenforceable provision shall be considered modified to the extent necessary to make it valid and enforceable, consistent with applicable law.

OTHER GENERAL PROVISIONS

The section titles in these Terms and Conditions are provided for convenience only and do not define, limit, or extend any provision of the Terms and Conditions. The term "including" as used herein means "including without limitation." Our failure to exercise any right or enforce any provision does not constitute a waiver of that right or provision. Neither party shall be considered the agent or partner of the other party.

These Terms and Conditions cannot be assigned by you without our prior written consent; any attempted assignment in violation of this condition shall be null and void. We reserve the right to assign any of our rights under these Terms and Conditions to any third party without requiring your prior written consent. The provisions of these Terms and Conditions shall be binding upon any permitted assignees.
